I was working in Reliance Infrastructure Limited, Mumbai and superannuated w.e.f. 16th August, 2019. In Reliance Infrastructure Limited, there is its own PF Trust created for the benefits of the employees of the company.
More than four and half months (140 days) have been over, but still Company has not paid my PF fund. I had sent my complaints/ Reminders more than five times to the company, but it were unaddressed/ unnoticed by them.
I have come to know that Company PF fund Trust has huge loss on investment made and the same has not been reimbursed by the company. PF Fund Trust has more than 200 cases pending. The valuation of investment and other records filed by the Trust to you are created records and not based on real valuation.
Inhouse PF Trust flouting rules and not pay dues to their employees. Many companies have been accused of misusing employees’ PF fund corpus as their own working capital.
In-house PF trust should be more employee friendly. Traditionally, private trusts used to invest in government securities and units of mutual funds which provided for better earnings vis-a-vis the earnings generated through EPFO. This provided leverage to corporates to provide better returns to the employees.
In case of non receipt of due, an employee can file a complaint against the Trust, Trustees and Directors under Section 405 of the Indian Penal Code for criminal breach of trust.
In view of above, you are requested to look into the affairs of the Reliance Infrastructure PF Trust and get the report at the earliest. The company has influence in the Department and on that base the company is cheating to the employees.
